Terms of Service

1. Acceptance of Terms

By accessing or using ForemanOS (“the Service”), you agree to be bound by these Terms of Service. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these terms. If you do not agree, do not use the Service.

2. Service Description

ForemanOS provides construction project intelligence software, including real-time dashboards for cost tracking, schedule management, daily field operations, safety compliance, and document management. The Service is provided on a subscription basis and may be updated or modified at our discretion.

3. User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You agree to notify us immediately of any unauthorized use. Each account is for a single user unless your subscription plan permits multiple users.

4. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to gain unauthorized access to the Service or related systems
• Reverse engineer, decompile, or disassemble any part of the Service
• Share account credentials with unauthorized users
• Upload malicious code or interfere with the operation of the Service
• Use the Service to store or transmit content that infringes intellectual property rights

5. Data Ownership

You retain all rights to the construction project data you upload to ForemanOS. We do not claim ownership of your project budgets, schedules, daily reports, photos, or other project information. You grant us a limited license to process and display your data solely to provide the Service.

6. Intellectual Property

ForemanOS, its logos, and all software, dashboards, algorithms, and documentation are the intellectual property of ForemanOS and are protected by copyright and other intellectual property laws. Your subscription grants you a limited, non-exclusive, non-transferable license to use the Service.

7. Payment and Billing

Subscription fees are billed in advance on a monthly or annual basis. All fees are non-refundable except as required by law. We reserve the right to change pricing with 30 days' written notice. Failure to pay may result in suspension or termination of your account.

8. Limitation of Liability

To the maximum extent permitted by law, ForemanOS shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the fees paid by you in the 12 months preceding the claim. The Service is provided for project management purposes and should not be the sole basis for construction safety or structural decisions.

9. Termination

Either party may terminate this agreement at any time. Upon termination, you may request export of your project data within 30 days. After that period, we may delete your data in accordance with our data retention policies. Provisions that by their nature should survive termination will remain in effect.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Kentucky, without regard to conflict of law principles. Any disputes arising from these terms shall be resolved in the state or federal courts located in Kentucky.

11. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated via email or through the Service at least 30 days before taking effect. Continued use of the Service after changes constitutes acceptance of the updated terms.
